Draft Guidelines on States’ Defenses and Prevention of Investment Arbitration

Our panel on States’ Defenses and Prevention of Investment Arbitration will discuss the current version of the Draft Guidelines that lead to a set of best practices and non-binding actions that States may take to mount an effective defense in investment arbitration or to prevent investment disputes. To facilitate the discussion, the panel will have as panelists current government officials with experience as counsel in investment arbitrations, and private practitioners who have represented sovereign States. The panel will provide insight on: 

• • • The steps that States should follow in the treaty drafting and implementation process;
    • Best practices States could implement to prevent investment disputes against them;  and
    • Steps to follow in order to face investment arbitration and other important aspects States should consider during and after the proceedings.
